2. Intellectual Property
You declare that you understand that all the information, designs, text, graphics, code, software and any other materials contained in this website, as well as arrangement thereof are copyrighted to Gold Buying Centre and are protected by copyright law. ALL RIGHTS ARE RESERVED.
Permission is granted to you to electronically copy and to print hard copy portions of this website for the sole purposes of personal non-commercial use under the condition that you agree not to change, delete and/or modify any content, web design and/or layout contained in that material.

3. Requirements for Use
1. You must be at least eighteen (18) years old to conduct a transaction with Gold Buying Centre.
2. You must be the actual owner of the property you intend to sell and if demanded you shall be able to prove the right of ownership of the property by providing a purchase receipt.
3. You must act on your own behalf.
4. You must be domiciled in the United Kingdom.

4. The Gold Calculator
The Gold Calculator feature is for the user's convenience and shall only be treated as displaying an approximate price of the gold, providing that the information given is accurate (based upon current market gold value on the day of use, and not necessarily the price of gold on the day we receive your goods). The Gold Calculator's generated price shall not be treated, therefore, as a binding offer which the user accepts by sending the goods.

5. Delivery, Receipt and Return of your Goods
On receipt of your gold package, Gold Buying Centre will confirm receipt by e-mail. Packages sent to us by Royal Mail Special Delivery can also be tracked online at www.royalmail.com.
Gold Buying Centre reserves the right, at its sole discretion to reject delivery of any mail, envelope or package which appears to be damaged, opened or tampered with and any such mail, envelope or package will be returned by the carrier to the customer. Gold Buying Centre shall have no liability to any customer for any such attempted delivery or return of any such items.
Gold Buying Centre reserves the right, at its sole discretion, to apply a charge for postage and packaging of items returned to the user, particularly the return of items found not to be made of gold. If a non-gold item is found in a consignment, we reserve the right to deduct the cost of the return of the invalid item from the purchase price of the remainder of the consignment.

6. Mixed Carat Consignments
Gold Buying Centre is happy to receive packages of assorted Carat gold. Your gold will be sorted, tested and accurately weighed and the resulting breakdown of values per Carat type will be given to you when we call or e-mail you to make an offer to purchase.

7. Gold Plated and Non Gold Items
Please note that whilst we are prepared to purchase gold which is not hallmarked we reserve the right to make a reasonable charge for time spent testing items which are found to be Gold Plated or not to contain gold. (Max £30)

8. Gemstones in your Consignment
Gold Buying Centre do not buy gemstones. Any gemstones within items of gold received will not be returned as removal of such stones is time consuming and in most cases the labour charges generated would far outweigh the small profit margin that we may have in the item of gold. We recommend that, if a stone is of sentimental value, you remove it before sending the item to us.

9. Our Offer to Purchase
Once your items have been tested and valued Gold Buying Centre will contact you either by telephone or e-mail to make our offer to purchase your gold. This offer is based upon the market price of gold on the day on which Gold Buying Centre receives the goods and is subject to the expertise of our valuation department. Gold Buying Centre guarantees the offer agreed with the user for 24 hours thereafter, regardless of any gold market price fluctuations.
If our offer is not accepted within 24 hours, then Gold Buying Centre reserves the right to re-evaluate the offer based on any fluctuations in world gold prices.
If you choose to refuse our offer to purchase, Gold Buying Centre will return your consignment to you by Royal Mail Special Delivery. In such circumstances Gold Buying Centre reserves the right, at its absolute discretion, to charge the user for postage and packing of the returned consignment (Max £15) and also at it's discretion to impose a fee to offset the cost to us of time spent testing the consignment (Max £30).

10. Our Payment to You
Once you have accepted our offer to purchase, payment can be made in one of three ways:
1. Faster Payment System (FPS) - where the money will be in your account within 2 hours.
2. BACS payment where the money will be in your account within 4 working days.
3. We will send a cheque out to you within 24 hours.

11. Service Interruptions
Gold Buying Centre will endeavour to the best of its ability to limit any interruptions to the provision of the service, but will not be obliged to refund monies in respect of temporary access limitations whether they are the fault of Gold Buying Centre's service provider or the fault of Gold Buying Centre itself. Gold Buying Centre reserves the right to suspend, restrict or terminate the service at any time for any duration of time with no liability. The user accepts that it might be necessary for Gold Buying Centre to suspend the service for technical reasons

12. Hyper-Linking
It is our policy to obtain permission to link to other websites. Gold Buying Centre is not responsible for the content or reliability of any linked websites and does not necessarily endorse the views expressed within them. Listing should not be seen as endorsement of any kind and is made for the user's convenience only. We cannot guarantee that links will work all of the time and we have no control over the availability of linked pages.

13. Virus Protection
Gold Buying Centre makes every effort to check and test material at all stages of production. It is always wise for 'Users' to run an anti-virus programme on all material downloaded from the web. Gold Buying Centre will not accept any liability for any loss, disruption or damage of any kind to your data or computer system which may occur whilst using material from this website.

15. Data Protection
Your personal information and payment details will be protected in accordance with the Data Protection Act 1998.
Gold Buying Centre will only use information provided for the purposes of Administration, Customer Services, Internal Marketing and stringently tested partners. We may want to contact you about a range of discounts and special offers on other products and services from Gold Buying Centre and our partners. We may also want to contact you by text or by multimedia messaging service (MMS). We will not share your information with any other third party. We may keep information provided by you the 'User' or cardholder to contact you with notification of other services or offers. When the 'User' supplies information regarding another person they do so with the express understanding that the other person has granted permission to do so, and they have granted authorisation to act in this manner. Gold Buying Centre will not be held responsible for any breach of this understanding.

You have the right to request a copy of any information held by us, there is an administration fee of £10 for this procedure. This must be requested in writing to the address above, signed by you. You may request us to correct any inaccuracies in the information held on you. Such a request must be in writing, signed and sent to the address above.
Business customers
The Data Protection Act does not generally apply to companies but it does cover sole traders and partnerships. When we receive an application for a 'Service' from a business we may perform a search with a credit reference agency on the individual company directors or partners.
The Data Protection Act puts obligations on users of personal information and lays down principles for its use. One principle states that information has to be processed fairly and lawfully. This means that you are entitled to know how we intend to use any information you provide.
You can then decide whether you want to give it to us. To provide outstanding customer service we need accurate customer information. You can help by informing us whenever your circumstances change. 16. Limitation of Liability
This limitation of liability shall be binding on each and every customer and any third party, including, but not limited to, the customer and the customer's successors, assigns, insurance carriers and any other individual or entity asserting any right or claim relating to customer's transaction with Gold Buying Centre.
No liability will be accepted for loss or damage resulting from the use of services offered by Gold Buying Centre, and in no event shall Gold Buying Centre be liable to any third party, including any insurance carrier. Gold Buying Centre shall not be liable for any subrogation claim brought by customer's insurance carrier and, by submitting an item to Gold Buying Centre, the customer expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier.
To the maximum extent permitted by applicable law Gold Buying Centre shall not be liable to anyone for any damages, including but not limited to, incidental, consequential, punitive, loss of profit or opportunity.
Gold Buying Centre makes no representations, statements and warranties of any kind that the services provided by us will meet your expectations.
By submitting the item, the customer explicitly and expressly accepts this limitation of liability as well as the remainder of the terms and conditions.

17. Indemnification
You agree to indemnify, defend and hold us and our affiliated companies, shareholders, officers, directors, employees, agents or suppliers harmless from any and all claims or demands, made by any third party due to or arising out of your use of the services, the violation of these terms and conditions by you, or the infringement by you of any intellectual property or other right of any other person or entity.

18. Miscellaneous
1. By using the service and therefore accepting the terms and conditions stated above you agree that these Terms and Conditions shall be governed and interpreted in accordance with the law of England and Wales and that any potential dispute will be subject to the jurisdiction of the Courts of England and Wales.
2. Gold Buying Centre reserves all rights to update these terms and conditions from time to time without notice provided. It is entirely your responsibility to check before using Gold Buying Centre whether such updates occurred.
3. In the event that any of the terms and conditions stated herein is considered to be invalid by a court, this shall not affect the remainder part of these terms and conditions.
